1. Eligibility
   You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or participate in Sweepstakes. Use of the Site is void where prohibited. By using the Site, you represent and warrant that you meet these requirements.

2. Account Registration
   To participate in Luck eStakes Sweepstakes, you must create an account. You agree to:
   • Provide accurate, complete, and current information;
   • Maintain and update your information as necessary;
   • Maintain the security of your account credentials;
   • Accept responsibility for all activity under your account.
   Luck eStakes reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.

3. Entry & Participation
   Participation in Sweepstakes is governed by the Official Rules, which are incorporated by reference into these Terms. In case of conflict, the Official Rules control.

4. Payment & Vault
   Paid entries may be made by direct payment or using funds deposited into your personal online Vault.
   
   By depositing funds, you authorize us to charge your chosen payment method.
   
   All deposits are final unless otherwise required by law.
   
   Vault funds may not be withdrawn or redeemed for cash after deposit, and can only be used for in-Site purchases. Vault funds are non-transferable and have no independent cash value outside the Site.

5. Prizes & Taxes
   Prizes are awarded as set forth in the Official Rules. You are solely responsible for any taxes, fees, or reporting obligations resulting from your winnings. For U.S. residents, Form 1099-MISC will be issued for annual winnings greater than or equal to $600.00. For non-U.S. residents, Form 1042-S applies.
   
   Sponsor may require potential winners to complete an affidavit of eligibility and liability/publicity release before prize award.
   
   All amounts are denominated in U.S. Dollars. Any conversion to other currencies is subject to exchange rates and fees applied by payment processors or banks.

6. Email, Identity, and Tax Compliance Requirements
   To remain eligible for earnings payouts, members must:
   • Maintain a verified and valid email address associated with their account;
   • Complete any required identity verification procedures when requested;
   • Submit accurate and complete tax documentation when required by law.
   
   Luck eStakes reserves the right, at its sole discretion, to withhold, delay, suspend, deny, reverse, or cancel earnings payouts for any account that:
   • Fails to maintain a verified email address;
   • Provides inaccurate or misleading identity information;
   • Does not complete required identity verification;
   • Fails to submit required tax documentation;
   • Attempts to circumvent verification or eligibility requirements;
   • Engages in conduct that compromises the integrity or compliance of the Sweepstakes.
   
   Payouts may be delayed until all compliance requirements are fully satisfied. Members are solely responsible for maintaining accurate account information and completing required verification steps in a timely manner. Any attempt to bypass verification, create duplicate accounts, or manipulate eligibility requirements may result in permanent account termination, forfeiture of winnings, and potential legal action where applicable. Luck eStakes shall not be liable for forfeited or delayed payouts resulting from a member’s failure to comply with verification or tax requirement.

7. Offer Wall
   Luck eStakes may provide third-party “offer wall” opportunities where users can complete tasks for free entries. Sponsor is not responsible for the content or performance of third-party offers. Participation is at your own risk.

8. Site Fees
   Luck eStakes charges a site fee on entry pools:
   • 15% fee on Site Pots.
   • 1% additional fee on Member Posted Pots.
   All fees are deducted before prize distribution.

9. Prohibited Conduct
   You agree not to:
   • Engage in fraud, collusion, cheating, or use of bots/automation;
   • Attempt to circumvent entry limits or eligibility requirements;
   • Use the Site for unlawful purposes;
   • Harass, abuse, or harm other users.
   Luck eStakes may suspend or terminate your account for violations.

10. Member-Posted Pots
    Registered users may create their own Pots subject to Sponsor approval and these Terms. Member Posted Pots must comply with all laws and may not:
    • Contain unlawful, misleading, or deceptive prize structures;
    • Promote hate, violence, harassment, or illegal activity;
    • Infringe the intellectual property or rights of others.
    Luck eStakes reserves the right to reject, remove, or close any Member Posted Pot at its sole discretion.

11. Refund & Cancellation Policy
    All entries are final and non-refundable. In the event a Pot is canceled or voided due to technical error, fraud, or any other Sponsor-determined issue, entries will be refunded to the entrant’s Vault. Vault deposits themselves are non-refundable except where required by law.

12. Chargebacks & Payment Disputes
    Initiating a chargeback, payment reversal, or dispute through your card issuer or payment provider, instead of first contacting Luck eStakes Help Center, may result in temporary suspension of your account while the transaction is reviewed. Due to the nature of sweepstakes-based platforms and the requirements of our payment processors, chargebacks are treated as potential fraud or compliance events and must be investigated. If you believe a transaction was made in error or you have a concern regarding a charge, please contact our help centrer team first. We are often able to resolve issues directly and promptly without the need for a chargeback and without impacting your account. Repeated or excessive chargebacks may result in further account restrictions or termination, as such activity can jeopardize our ability to maintain payment processing services.

13. Advertising & FTC Disclosure
    If you promote Luck eStakes through affiliate programs, influencer campaigns, or social media, you must comply with all applicable FTC Endorsement Guidelines and platform-specific rules. Disclosures such as #ad, #sponsored, or #sweepstakes must be clear and conspicuous. Failure to comply may result in disqualification or termination of your account.

14. Intellectual Property
    All content, logos, trademarks, software, and designs on the Site are owned by Luck eStakes or its licensors. You may not copy, distribute, or create derivative works without express written consent.
    
    By submitting any content to the Site, you grant Luck eStakes a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with the operation of the Site. See Privacy Policy for details.
    
    You represent and warrant that you own or have the necessary rights to any content you submit, and that such content does not infringe the rights of any third party.

15. Disclaimer of Warranties
    The Site and Sweepstakes are provided “as is” and “as available.” We make no warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

16. Limitation of Liability
    To the fullest extent permitted by law, Luck eStakes and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill. Our total liability to any user shall not exceed the amount paid by such user to enter Sweepstakes in the preceding six (6) months.

17. Indemnification
    You agree to indemnify and hold harmless Luck eStakes, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.

18. Governing Law
    These Terms and the Sweepstakes are governed by the laws of the State of Kentucky in the United States, without regard to conflict-of-law principles.

19. Disputes and Arbitration Clause
    Any disputes or claims arising out of or relating to the Sweepstakes or these Terms shall be resolved by binding arbitration in Kentucky, conducted in accordance with the rules of the American Arbitration Association. Entrants agree to waive the right to trial by jury or to participate in a class action.
    
    Nothing in this section shall prevent Luck eStakes from seeking injunctive relief in a court of competent jurisdiction.

20. Termination
    Luck eStakes reserves the right to suspend or terminate accounts, or restrict access to the Site, at its sole discretion, with or without notice, for any violation of these Terms or applicable law. Luck eStakes also reserves the right to modify, suspend, or terminate any Sweepstakes at its discretion if fairness, security, or proper administration is compromised.

21. Amendments
    We may update these Terms at any time by posting a revised version on the Site. Your continued use of the Site after changes indicates acceptance.

22. Responsible Play
    Luck eStakes promotes responsible participation. Gambling involves risk, and users should never deposit or enter more than they can afford to lose. If you feel your play is excessive, please contact us via our Help Center to discuss account limitations or self-exclusion. 23. International Use
    The Site is operated from the United States. If you access the Site from outside the U.S., you are responsible for complying with your local laws. Some jurisdictions may restrict sweepstakes or prize promotions; by using the Site, you represent and warrant that such participation is legal in your jurisdiction. The Sweepstakes is void in jurisdictions where prohibited or restricted by law.

24. Payment Processing
    Payments, deposits, and withdrawals may be facilitated by third-party payment processors. By using the Site, you authorize Luck eStakes and its processors to store and process your payment information. Luck eStakes is not responsible for delays, errors, or failures caused by third-party processors.

25. Fraud & Abuse
    Any attempt to manipulate results, exploit site mechanics, create duplicate accounts, or use bots, scripts, or automated tools is strictly prohibited. Suspected fraud will result in disqualification, forfeiture of prizes, and possible referral to legal authorities.

26. Force Majeure
    Luck eStakes is not liable for failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, internet outages, payment processor failures, cyberattacks, government restrictions, or labor disputes.

27. Severability
    If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

28. Waiver
    Failure by Luck eStakes to enforce any provision of these Terms shall not constitute a waiver of such provision.

29. Terms Survival
    Sections relating to Intellectual Property, Limitation of Liability, Indemnification, Governing Law, and Arbitration shall survive the expiration or termination of these Terms.

30. Entire Agreement
    These Terms, together with the Official Rules, Privacy Policy, and Cookies Policy constitute the entire agreement between you and Luck eStakes regarding use of the Site and supersede any prior agreements.
